DMCA takedown policy

Sexnomad respects the intellectual property rights of others. If you believe content on this site infringes a copyright you own or are authorized to act for, you may submit a takedown request under the Digital Millennium Copyright Act (DMCA) and similar international laws.

What to include in a DMCA notice

A valid DMCA takedown notice must include all of the following:

  1. A physical or electronic signature of the copyright owner or their authorized agent.
  2. Identification of the copyrighted work claimed to have been infringed.
  3. Identification of the material that is claimed to be infringing — including the specific URL on Sexnomad where the material appears.
  4. Your contact information: full legal name, mailing address, telephone number, and email address.
  5. A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
  6. A statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner.

We respond to valid notices promptly — generally within 5 business days. We remove or disable access to material that we determine in good faith to be infringing.

Counter-notice procedure

If material you posted was removed in response to a DMCA notice and you believe the removal was in error, you may submit a counter-notice. A valid counter-notice must include:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed and its prior location on the site.
  3. A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court for the judicial district in which your address is located (or, if your address is outside the United States, for any judicial district in which the service provider may be found).
  5. A statement that you will accept service of process from the original complainant.

Repeat-infringer policy

Sexnomad maintains a policy of terminating, where appropriate, accounts of users who are determined to be repeat infringers.

Misrepresentation

Knowingly making material misrepresentations in a DMCA notice or counter-notice can result in liability under 17 U.S.C. § 512(f). Do not submit a takedown notice for material you don't have rights to or that constitutes fair use.

International rights holders

Although the DMCA is a US law, we accept and act on equivalent takedown requests under EU Copyright Directive (Article 17), UK CDPA, and other jurisdictional frameworks. Email editor@sexnomad.com for assistance with non-DMCA copyright matters.
